Purpose and general aspects

These General Conditions for Use, Conditions of Sale and Privacy Policy (hereinafter, "CU" govern the use of the website www.agroinnova.com (‘"the Website") hat is owned by Agroinnova S.L.U. Agroinnova S.L.U. is a Spanish limited liability company with address at Polígono Industrial ‘La Vega’, Carretera Salamanca, Nave 9 A-C, 47100 Tordesillas (Valladolid), registered in the Commercial Register of Valladolid in Volume 524, Folio 111, Page no. VA-4883,  First entry, and with tax ID number B47332978. Agroinnova S.L.U. provides information about its products and offers the possibility to purchase them through its site www.agroinnova.com. In any case, there are pages of the Website accessible to natural or legal persons who do not end up registering or initiating a product purchase (hereinafter, "Users"). In that regard, Users who access these parts of the Website agree to be subject to the terms and conditions set out in these General Conditions, to the extent that they may apply to them. Agroinnova S.L.U. would like to inform its Users that it is exclusively aimed at audiences over 18 years old and that the territory in which it accepts and distributes orders is Spain.

Prices

All product prices stated on the website include VAT and any other taxes that may apply. Shipping charges are not included . The prices only apply in Spanish territory, excluding Ceuta, Melilla and the Canary Islands. For other countries, please check by writing to agroinnova@agroinnova.com.

Availability

Agroinnova S.L.U. will do everything possible to satisfy all its Users in the demand for products. However, sometimes, and due to causes that are difficult to control by Agroinnova S.L.U. such as human error or incidents in computer systems, it is possible that a product may not be available after having made the order, in which case the user will be informed by email as to whether their order has been fully or partially cancelled. The partial cancellation of an order due to lack of availability does not give any entitlement to cancelling the entire order. If, due to this cancellation, the customer wishes to return the delivered product, they must follow the stipulations of the Returns section.

Payments

The buyer undertakes to pay at the time the order is made. The fees corresponding to the relevant shipping charges, if any, will be added to the initial price that appears on the website for each of the products offered. In any case, these fees will be notified to the User in advance before the purchase itself is finalised. The receipt corresponding to the purchase order will be available and will be sent via email to the address provided by the User in the Registration section. The buyer must pay the amount corresponding to their order by means of credit or debit card (Visa, MasterCard, American Express, Visa Electron and/or similar); it is also possible to pay by bank transfer. Users must notify Agroinnova S.L.U. by email or telephone of any incorrect or fraudulent charge made with the card used for the purchases, as soon as possible, so that Agroinnova S.L.U. can take the appropriate steps.

Finalisation of orders

Once the order has been finalised, i.e. with the acceptance of the CU and confirmation of the purchasing process, Agroinnova S.L.U. will always send the User an email confirming the details of the purchase made.

Cancellations

Agroinnova S.L.U. will accept order cancellations where this is requested before the end of the day on which the purchase was made; Agroinnova S.L.U. will accept order cancellations where they are requested WITHIN THIS PERIOD. To cancel, an email must be SENT to agroinnova@agroinnova.com to request the cancellation of the order, with the purchase order attached as a guarantee of ownership of this purchase order. Order cancellations will not be accepted once the purchase has been shipped, given the personal nature, purpose and destination of the products marketed.

Delivery periods, location and losses

  1. Product delivery

Agroinnova S.L.U. undertakes to deliver the product in perfect condition to the address the User has stated on the order form; this address must be within Spanish territory in all cases. In order to optimise the delivery, we would be grateful if Users could provide an address to which the order may be delivered within normal working hours. The order will be delivered personally and will need to be signed for; if the User is not in at the time of delivery, the delivery company will leave a note so the User can contact them and arrange a new delivery date or place to pick up the order. The prices charged by default on the website are those set by the delivery company. Agroinnova S.L.U. will assume no responsibility for errors in delivery in the event that the delivery address entered by the User on the order form does not match their actual address or if it has been omitted.

 

  1. Delivery period

Products have a delivery period between 24 and 48 working hours within mainland Spain; these periods are averages and therefore an estimation. It is thus possible that they will vary due to logistical reasons or force majeure. In cases of delayed deliveries, Agroinnova S.L.U. will inform its customers as soon as it becomes aware of such delays. Each delivery is considered to have been made from the moment at which the delivery company makes the product available to the User, which takes place through the control system used by the delivery company. In the event of delays to the delivery of orders attributable to Agroinnova S.L.U. Users may cancel their order in accordance with the procedure described in the section "Returns procedure". Any cases in which the order has been made available to the User by the delivery company within the agreed period and where it has not been possible to deliver it for a reason attributable to the User, will not be considered delays in the delivery.

  1. Delivery details, undelivered orders and losses

If the User is not in at the time of delivery, the delivery company will leave a note so the User can contact them and arrange a new delivery date or place to pick up the order.

If the delivery has not been arranged after two working days from when the order was sent out for delivery, the User must contact Agroinnova S.L.U. In the event the User does not do so, after seven working days from when the order was sent out for delivery, it will be returned to our stores and the User will be responsible for the shipping and return charges for the merchandise, as well as any possible related administration fees.

If the reason the delivery cannot be made is because the parcel has been lost, our carrier will launch an investigation. Our carriers’ response times in these cases usually range from one to three weeks.

  1. Diligence in delivery

Users must check the good condition of the ordered product at the time the product is received. If, after reviewing the product, the User identifies any incident such as a knock, breakage, signs of having been opened or any imperfection caused to it through shipping, they may choose not to receive the order. The delivery company will notify Agroinnova, S.L.U. of this, and after verifying the imperfections, the order will be replaced or the order amount will be returned to the User, according to their preference.

Returns

Users have a period of two working days to return, at their cost, any items that are not to their satisfaction. This period will be counted from the day on which the parcel is delivered to the User. Agroinnova S.L.U. will only accept returns that meet the following requirements: 1. The product must be in the same condition as it was delivered in and it must be in its original packaging without having been unsealed. 2. The shipment must be made using the same box or envelope we sent you, or else in a similar format that will ensure it is returned in perfect condition. 3. A copy of the delivery note/invoice must be included inside the parcel, where the returned products will also be marked as well as the reason for return. In order to make the return process easier for Users and to be able to follow it up correctly, if the reason for return is attributable to Agroinnova S.L.U. (e.g. the product is defective, it is not what you ordered, etc.), there is no charge for this service. If the reason for return is something else (e.g. the products were provided correctly but not to your liking), Agroinnova S.L.U. will cover the cost of the products less the shipping charges, which will be deducted from the repayment according to the cost of shipment in each case. To go ahead with the return, the User must communicate this by email to agroinnova@agroinnova.com, stating "CANCELLATION OF ORDER NO." in the subject line and specifying the products they wish to return within the return period. Users may also communicate this by telephone by calling (+34) 983 797070. Agroinnova S.L.U. will contact the User as soon as possible.

Intellectual and industrial property

Agroinnova S.L.U. holds all the rights regarding the content, design and source code of this website and, in particular, including, but not limited to, regarding the photographs, images, texts, logos, designs, brands, trade names and data that are included on the site. Users are advised that these rights are protected by the Spanish and international law currently in force concerning intellectual and industrial property. Moreover, and without prejudice to the above, the contents of this site are also considered a computer programme and, therefore, all Spanish and European Community regulations on the subject currently in force also apply.

It is expressly prohibited to reproduce this site in full or in part, not even via a hyperlink, or any of its content, without express permission in writing from Agroinnova S.L.U. It is likewise completely prohibited to copy, reproduce, adapt, modify, distribute, market, publicly communicate and/or carry out any other action that may entail an infringement of the Spanish and/or international regulations on intellectual and/or industrial property currently in force, as well as to use the site contents, if this is not done with prior express authorisation from Agroinnova S.L.U. in writing. Agroinnova S.L.U. states that it does not grant any licence or implicit authorisation in relation to the intellectual and/or industrial property rights or in relation to any other right or property related, directly or indirectly, to the content included on the site.

Privacy policy Protection of personal data

Users undertake to browse the site and use the content in good faith. Pursuant to Organic Law 15/1999 on Protection of Personal Data, we hereby inform you that filling in any form on the Website agroinnova.com or sending an email to any of our addresses: 1. will be treated with utmost confidentiality and will form part of the files owned by Agroinnova S.L.U. to be managed and answered, as well as for the commercial management that forms our relationship, for the sending via email of the sales made by Agroinnova S.L.U. for the delivery of the purchases and for providing information on the offers we believe may be of interest to you; 2. implies the acceptance of this privacy policy, as well as authorising Agroinnova S.L.U. to process any personal data you provide to us. Users do not provide any personal information nor are obliged to do so just by visiting the site. The computer where the site is accommodated uses cookies to improve the service provided by Agroinnova S.L.U. These cookies are installed automatically on the computer used by Partners and Users, but they do not store any kind of information related to these Partners or Users. Agroinnova S.L.U. presumes that the data have been entered by their owner or by a person authorised by their owner, as well as that they are correct and exact. In accordance with the current legislation on data protection, Agroinnova S.L.U. has adopted the appropriate levels of security for the data provided by Users and, in addition, has installed all the means and measures available to it to prevent the loss, misuse, alteration, unauthorised access and extraction of these data.

Access, rectification, cancellation and opposition

Partner data Users are responsible for updating their own data. The User will, at any time, have the right of access, rectification, cancellation and opposition for all their personal data included in the different registration forms. To exercise this right, the Partner must write to Agroinnova S.L.U. by post, at Polígono Industrial "La Vega", Carretera de Salamanca, Nave 9 A-C, 47100 Tordesillas (Valladolid), Spain. The User is therefore responsible for the accuracy of the data, and Agroinnova S.L.U. will not be held responsible for the inaccuracy of User personal data.

Invalidity

In the event that any clause of these CU is declared invalid, the other clauses will remain in force and will be interpreted taking into account the wishes of the parties and purpose of these CU. Agroinnova S.L.U. may refrain from exercising any of the rights and powers conferred in this document, which will in no case imply the renunciation of the same, save express acknowledgement by Agroinnova S.L.U. or the termination of the relevant action in each case.

Modification of the conditions of use

Agroinnova S.L.U. reserves the right to modify, at any time, the presentation and configuration of the Website, as well as these General Conditions. Therefore, Agroinnova S.L.U. recommends that Users read these conditions carefully every time they access the Website. Users will always have these CU in a visible, freely accessible place, for any enquiries they wish to make. In any case, acceptance of the CU will be a first and essential step for acquiring any product that is available through the Website.
